NSW Seat Belt Laws & Penalties

Wearing a seatbelt is mandatory for all drivers and passengers, and failure to comply can result in significant fines along with demerit points.​

Seatbelt Detection Cameras

Since July 1, 2024, NSW has implemented seatbelt detection cameras in order to enforce compliance. The initiative aims to reduce fatalities caused by non-compliance, with the cameras being able to automatically identify:​

  • Drivers and passengers not wearing seatbelts.​​
  • Incorrectly worn seatbelts (e.g., sash under the arm).​​
  • Unrestrained children.​​

In the first three weeks, over 11,400 fines were issued, totaling $4.7 million.


Proper Seatbelt Usage

To be as effective as possible, seatbelts must be worn correctly:​

  • Lap belt: Positioned low across your hips, not stomach.​
  • Shoulder sash: Across your chest and mid-shoulder, not under your arm or behind your back.​
  • No twists: Ensure the belt is flat and firm.​

Improper usage can result in fines and increases the injury risk during an accident.​


Child Restraint Requirements

Ensuring any children are properly restrained is crucial for their safety, and NSW law mandates specific restraints according to a child's age:​

  • Under 6 months: Rear-facing child restraint.​
  • 6 months to under 4 years: Rear or forward-facing child restraint with an inbuilt harness.​
  • 4 years to under 7 years: Forward-facing child restraint with inbuilt harness or booster seat.​
  • 7 years and over: Booster seat or adult seatbelt, depending on size.​

Front seats: Children under 4 years must not sit in the front seat of a vehicle with two or more rows. Children aged 4 to under 7 are only permitted to sit in the front if all rear seats are occupied by younger children.
